Building Permit Information
Building Permits can be emailed to buildingpermits@gardnerkansas.gov.
Residential Building Permits
New Home Construction
Contractors applying for new home construction should submit the following to the Codes Division:
- Completed Building Permit Application
- 1 set of digital construction plans (PDF format), sealed (if house has not been "Master Planned")
- 1 stamped and signed original plot plan and 1 digital copy
All contractors, including subcontractors, must hold a Johnson County Contractor's license.
Miscellaneous Residential
In addition to building a new home, the City of Gardner also requires building permits for many home improvement projects such as finishing a basement, re-roofing, setting an outdoor shed, installing a sprinkler system, setting a swimming pool, or building a fence or deck. Homeowners can do work on their own home however any contractor you hire must hold a Johnson County Contractor's license with the exception of fence, and irrigation contractors. If you are unsure whether your contractor is licensed, please check the Johnson County's Contractor database.
If you are performing the work as the homeowner please submit Statement of Homeowner Installation. with your application.

Commercial Construction
New Commercial Construction
Contractors applying for new commercial construction should submit the following to the Codes Division:All contractors, including subcontractors, must hold a Johnson County Contractor's license.
- Completed Building Permit Application
- 1 complete set of digital construction plans (PDF format) and 1 complete set of paper construction plans, sealed
- Site plan approved by or submitted to Planning and Zoning Division
Tenant Finish
Contractors applying for a tenant finish permit should submit the following to the Codes Division:
- Completed Building Permit Application
- 1 complete set of digital construction plans (PDF format) and 1 complete set of paper construction plans, sealed
All contractors, including subcontractors, must hold a Johnson County Contractor's license.

Building Inspection

All building permits will require inspections at various stages of construction. The Building Inspector will inspect construction relative to approved plans and the attached comments. If the project complies with plans and all code requirements the inspector will provide approval for the work completed. In the event that any corrections are needed, the inspector will provide a list of items to be completed. The contractor or property owner is required to request all inspections associated with an issued building permit.
Third Party & Special Inspection Requests
The use of any third party or special inspector on construction projects requires pre-approval by the Community Development Department. The following is an outline of the request procedure:
- Written requests shall be sent electronically to the Plans Examiner at least 1 full business day prior to conducting the inspection.
- The request shall include the following information:
- the building permit number for the project (inspections conducted and requests made prior to the issuance of the building permit will not be accepted or when a City Building Inspector is available and qualified to perform the inspection);
- the name of the inspecting agency and individual doing the inspection with contact information;
- the address for the location where the inspection is to be conducted;
- the type of inspection to be conducted; and
- the time and date the inspection is expected to occur
- the justification / reason for the request
- the name and contact information of the builder / contractor making the request
- The request will be reviewed by the City and the builder / contractor making the request will be notified as to whether the request is approved or not prior to the occurrence of the inspection (the request will not be granted when a City Building Inspector is available and qualified to perform the inspection).
- If the request is approved an inspection report from the approved inspection agency / inspector shall be submitted to the Plans Examiner within 1 business day of the inspection.
- A City Building Inspector shall review the report and approve, ask for clarification / additional information or reject the report within 2 business days of the date the report is received. As part of the review the City Building Inspector may visit the site to conduct a walk through to assess the completed work. Rejection of the report or findings related to significant deficiencies in the inspection conducted or report provided by the approved inspection agency or inspector as well as concerns related to the work completed shall be cause to place a stop work order on the site and/or not allow future inspections to be conducted by the inspection agency and/or inspector within the City of Gardner.
