Annexation

Property for proposed developments must be annexed into the City of Gardner to utilize City utility services. A property must be annexed into the City before the initiation of the City zoning and development review process. Property that does not adjoin City boundaries, requires certain approvals from the Johnson County Board of County Commissioners.

Zoning and Rezoning

All properties within the City of Gardner carry zoning district classifications that govern the use and development of the land. The district regulations within the Zoning Ordinance, specify the uses permitted within each district, the minimum yard setbacks, density limitation, off-street parking requirements, and similar development restrictions.

Conditional Use Permits (CUP) and Special Use Permits (SUP)

Land uses that are not permitted within a particular zoning district, such as hospitals, airports, and quarries, are typically approved through the Special Use Permit (SUP) process.

Land uses that are only permitted within a particular zoning district under specified conditions relating to operation, site development, and time limits after review and approval by the Planning Commission and City Council, are allowed through the Conditional Use Permit (CUP) process.

Preliminary and Final Plats

The City of Gardner requires that all property must be platted before any building permits may be issued for improvements to the property. Platting involves the subdivision of land into lots or tracts. A plat is prepared only by a licensed engineer or surveyor, and is recorded as a permanent legal document that includes an accurate description and a graphical depiction of any real property that is to be divided. The intent of platting is to provide a readily accessible and easily understandable public record of property. Units of property that have been created by platting can be easily transferred between interested parties.
 
The purpose of platting is to ensure:
 
* a sensibly arranged pattern of lots for the intended uses
* that streets and public improvements are planned to serve the needs of each lot as well as surrounding properties;
* that consistency is maintained between subdivisions; and
* that an opportunity is provided for public review and comment on the proposed plat layout.

  
Subdivision plats indicate:

* Sizes and shapes of lots
* Relationships between existing and future streets
* Locations of proposed public improvements
* Locations of lands dedicated for public purposes

Site Plan / Development Plan

The purpose and intent of requiring site plan approval is to encourage the compatible arrangement of buildings, off-street parking, lighting, landscaping, pedestrian walkways and sidewalks, ingress and egress, and drainage on the site and from the site, any or all of these, in a manner that will promote safety and convenience for the public and will preserve property values of surrounding properties.
